Thank you for using MailOptimal! We take your privacy extremely seriously. We do not store, sell, or transmit information in your inbox. Our code meets the latest Content Security Policy (CSP) recommendations, ensuring you can keep browsing the Web safely.

We would like to describe how we collect, use, and protect your information when you access our website(s), products, services, and applications (collectively, the “Services”).

This Privacy Policy is an integral part of our Terms of Service. Before you use MailOptimal, please read this Privacy Policy carefully. By using or accessing our Website and/or Services, you are accepting the practices described in our Privacy Policy and you agree that we will collect, use, and share your information in the following ways.

What does this Privacy Policy cover?

This Privacy Policy covers our treatment of personally identifiable information (“Personal Information”) that we gather when you are accessing or using our Services. We gather various types of Personal Information from our users, as explained in more detail below, and we use this Personal Information to make our Services available to you, to contact you, and to better understand how you use the Services. In certain cases, we may also share some Personal Information with third parties, but only as described below.

We do not knowingly collect or solicit personal information from anyone under the age of 16. If you are under 16, please do not attempt to register for the Services or send any personal information about yourself to us. If we learn that we have collected personal information from a child under age 16, we will delete that information as quickly as possible. What Information Does MailOptimal Collect?

What Information Does MailOptimal Collect?

Our company’s overriding policy is to collect as little user information as possible. We collect various types of information in order to improve services for our users. This includes information you provide to us as well as information we receive when you use our service which may include;

  • Personal Contact Details: Full Name, Address, E-mail Address, Phone Number
    • Purpose for Prospects: We process this type of Personal Data to sell and market our Services to potential customers who have requested demonstrations of our Services.
      • Legal Grounds: We process this type of Personal Data based on the consent you expressly grant to us at the time we collect such Personal Data.
    • Purpose for Customers: We process this type of Personal Data to create an account for you and to provide you with our Services.
      • Legal Grounds: We process this type of Personal Data for our legitimate interests in providing the Services and associated support.
  • Other Personal Details: Type of Browser, page and/or feature selection, certain cookie information, device type, device ID, IP Address and associated location data
    • Purpose: We process this type of Personal Data in order to provide you our Services.
      • Legal Grounds: We process this type of Personal Data for our legitimate interests in providing the Services and performing web analytics to improve the Services and understand how our customers interact with the Services.
  • Personal Contact Details of Your Recipients: Information of the recipients, the subject of the email, and date and time in which the email was sent, page and/or feature selection, certain cookie information, device type, device ID, IP Address, and associated location data. (Accessed Data is the only information to which MAILOPTIMAL shall access to provide the Service. Authorizations for Gmail and the connection to your Google account as detailed in the Terms of Service are needed technically for the rendering of the Service by MailOptimal LLC and to provide the email tracking service, but do not imply access by MailOptimal LLC to any data or information of the User other than the Accessed Data.)
    • Information provided by the Service:
      • receipt confirmation;
      • open confirmation;
      • timestamp of each email opening;
      • history of the times (number, date and time) the recipient has opened the received email;
      • browser and operating system used by the recipient who opened the email;
      • number of links included in the email;
      • text and URL of such links;
      • the number of clicks made on each of them by the recipient;
      • timestamp of each click on the link; and
      • browser and operating system used by the person who has clicked on the link.
    • Purpose: We process this type of Personal Data in order to provide you our Services.
      • Legal Grounds: We process this type of Personal Data for our legitimate interests in providing the Services and associated support.
  • For your better understanding, this is the detail of the use of Gmail permissions by MailOptimal:
    • Basic permissions: Read your name, email address, aliases, and profile picture.
    • Read your emails: View your email metadata such as labels, headers, email recipients, and the email body. The Service only reads those emails that are sent using the MailOptimal email tracking service. It is useful in displaying email previews in the web application, to track replies of the recipient to provide engagement information.
    • Compose new emails: We only compose emails in your mailbox when you send emails using the MailOptimal tool using your email account authorization. We do not compose emails without your consent.
    • Send emails for you: No one from MAILOPTIMAL will send emails on your behalf and will never share the content of your emails without your consent. The Service only sends emails that are scheduled with the MailOptimal tracking service.
    • Delete your email: The Service does not use this permission, but unfortunately, it can not be removed separately.
    • Create, change, or delete your email labels: The Service requires you to add/modify your email labels based on the engagement data of your email (tracked with MailOptimal).
    • Get notified when certain kinds of emails appear in your Gmail inbox, like a travel confirmation: The Service notify you regarding the changes in your emails (sent with MailOptimal tracking) to keep you updated regarding the engagement activities.
  • Email content: Content of Customer’s email subject lines, recipient email address, email content (only when emails are sent using the MailOptimal Web App), and Templates.
    • Purpose: We process this type of Personal Data to provide you with our Services.
      • Legal Grounds: We process this type of Personal Data for our legitimate interests in providing the Services.
  • Cookies or other anonymous identifiers may be sent to your devices and may be used when you interact with our site or service.

Once using our Services, we may communicate with you if you’ve provided us the means to do so. For example, we may send you promotional email offers, or email you about your use of the Services. Also, we may receive a confirmation when you open an email from us. This confirmation helps us make our communications with you more interesting and improve our services. If you do not want to receive communications from us, feel free to unsubscribe or change your communication preferences.

How collected information is used

The information collected is used to maintain and improve the service. For example, allowing you to save settings, or modifying aspects of the service based on anonymous usage statistics. Information about support issues may be anonymously used as examples or to provide better support in the help center or FAQ. We will ask you for your permission before your information is used for any purpose not covered in the Privacy Policy.

  1. To personalize your experience, i.e, your information helps us to better respond to your individual needs;
  2. To improve our Services, i.e., we continually strive to improve our service based on the information and feedback we receive from you;
  3. To improve customer service, i.e., your information helps us to more effectively respond to your support needs.

Any data that we do have will never be shared except under the circumstances described below in Data Disclosure.

Data Disclosure

We do not sell, trade, or otherwise transfer your personal information except following this policy. This does not include trusted and GDPR-compliant third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect our or others’ rights, property, or safety.

 

Data Protection

We protect your data throughout the data flows of the MailOptimal product, from account creation and integration through Google’s OAuth service, to encryption of data in transit to MailOptimal’s servers (using browser-based TLS) and encryption of that data at rest (using AES-256), to a variety of administrative, physical, and technical safeguards designed to create a secure environment for our customers’ data. We use Amazon Web Services servers that have state-of-the-art digital and physical security with backup provided 24X7.  Unfortunately, still, this cannot ensure a complete guarantee and in certain cases may compromise the security of information.

Does MailOptimal Share Personal Information?

We neither rent nor sell your Personal Information to anyone. However, we may share your Personal Information with third parties as described in this section:

Group Accounts: If your MailOptimal Account is managed by a company or group administrator then the administrator or their agents may have access to your account information as well as all information and stats contained within your account. They may also have the ability to change information, and settings and restrict or suspend access to, or terminate your MailOptimal account

Agents and vendors: We employ other companies and people to perform tasks on our behalf and need to share your information with them, including in some cases the Personal Information you have provided to us, to make the Services available to you. For example, we may use third-party hosting providers or software developers to help implement and maintain the Services. However, our agents do not have any right to use the Personal Information we share with them beyond what is necessary to assist us.

Business Transfers: If we are involved in a reorganization, merger, acquisition or sale of our assets, your information may be transferred as part of that deal. We will notify you (for example, via a message to the email address associated with your account) of any such deal and outline your choices in that event.

Protection of MailOptimal and Others: We reserve the right to access, read, preserve, and disclose any information that we believe is necessary to comply with law or court order; enforce or apply our applicable terms of use and other agreements; or protect the rights, property, or safety of MailOptimal, our employees, our users, or others.

How Long Do We Retain Your Data?

We retain Personal Data about you for as long as you have an open account with us for 3 years after you close your account. In some cases, we retain Personal Data for longer, if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed, or is otherwise permitted or required by applicable law, rule, or regulation. Afterward, we retain some information in a depersonalized or aggregated form but not in a way that would identify us personally. However, user signup data (your name, your email address, and the fact that you were a MailOptimal user) may be retained in third-party analytics services beyond the closure of your account, unless you request that your data be deleted.

 

Whenever you interact with our Services, we automatically receive and record information on our server logs from your browser or device which may include “cookie” information. “Cookies” are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features in our Services are visited and by how many people. Personal Data of Children

We do not knowingly collect or solicit Personal Data from anyone under the age of 16. What Rights Do You Have Regarding Your Data as an EU Subject under GDPR?

EU Subjects have certain rights concerning their Personal Data, including those set forth below. For more information about these rights, or to submit a request, please email privacy@mailOptimal.com. Please note that in some circumstances, we may not be able to fully comply with your request, such as if it is frivolous or extremely impractical if it jeopardizes the rights of others, or if it is not required by law, but in those circumstances, we will still respond to notify you of such a decision. In some cases, we may also need to you to provide us with additional information, which may include Personal Data, if necessary to verify your identity and the nature of your request.

Access: You can request more information about the Personal Data we hold about you and request a copy of such Personal Data. You can also access certain of your Data by accessing your account settings.

Rectification: If you believe that any Personal Data we are holding about you is incorrect or incomplete, you can request that we correct or supplement such data. You can also correct some of this information directly by accessing your account settings.

Erasure: You can request that we erase some or all of your Personal Data from our systems.

Withdrawal of Consent: If we are processing your Personal Data based on your consent (as indicated at the time of collection of such data), you have the right to withdraw your consent at any time. Please note, however, that if you exercise this right, you may have to then provide express consent on a case-by-case basis for the use or disclosure of certain of your Personal Data, if such use or disclosure is necessary to enable you to utilize some or all of our Services.

Portability: You can ask for a copy of your Personal Data in a machine-readable format. You can also request that we transmit the data to another controller where technically feasible.

Objection: You can contact us to let us know that you object to the further use or disclosure of your Personal Data for certain purposes.

Restriction of Processing: You can ask us to restrict further processing of your Personal Data.

Right to File Complaint: You have the right to complain about MailOptimal’s practices concerning your Personal Data with the supervisory authority of your country or EU Member State.

Transfers of Personal Data

The Services are hosted in the United States (“U.S.”) through MailOptimal and its service providers, and if you do not reside in the U.S., laws in the U.S. may differ from the laws where you reside. By using the Services, you acknowledge that any Personal Data about you, regardless of whether provided by you or obtained from a third party, is being provided to MailOptimal and will be hosted on U.S. servers, and you authorize MailOptimal to transfer, store, and process your information to and in the U.S., and possibly other countries.

Fees for Use of the Service

The Service may be provided to You without charge up to certain limits or for a certain “trial” period.

Usage over this limit (or after the “trial” period) or requires Your purchase of additional resources or services.

For all purchased resources and services, we will charge Your credit card every month.

Payments are non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account.

Charges are solely based on MailOptimal’s measurements of Your use of the Service unless otherwise agreed to in writing.

All fees are exclusive of all taxes, levies, or duties imposed by taxing authorities, and You shall be responsible for payment of all such taxes, levies, or duties.

You acknowledge and agree that any credit card and related billing and payment information that You provide to MAILOPTIMAL LLC may be shared by MAILOPTIMAL LLC with companies who work on MAILOPTIMAL LLC’s behalf, such as payment processors and/or credit agencies, solely to check credit, effect payment to MAILOPTIMAL LLC and servicing Your account.

Cancellation & Termination

You must cancel Your account by first (1) Unsubscribing, and then (2) Uninstalling. You understand that solely uninstalling, disabling, or by forgoing the use of the Services will not be considered a cancellation of your subscription.

You may unsubscribe through the same workflow You followed to create your subscription: Dashboard > Subscription and Billing > Cancel Subscription.

You will not receive any refunds if you cancel your account. If You cancel the Service before the end of Your current paid-up month, Your cancellation will take effect immediately and You will not be charged again.

You agree that MailOptimal LLC, at its sole discretion and for any or no reason, may terminate or suspend your account. You agree that MailOptimal LLC will not be liable to You or any third party for such termination.

Application

Our Privacy Policy applies to all of the services offered by MailOptimal LLC.

Our Privacy Policy does not apply to services offered by other companies or individuals, or any sites that may be linked to from our website, or from companies that link to, or otherwise, advertise our service.
